All ordinance violations of the City of Herculaneum are heard in Jefferson County Associate Circuit Court.

Recommendation / Discovery Procedures

A request for a recommendation must be emailed to the Prosecuting Attorney at: HerculaneumPA@wegmannlaw.com.  All requests for recommendations MUST include a PDF copy of the following: (1) Entry of Appearance and or Request for Recommendation; (2) Driving Record of Defendant; (3) Copy of the Ticket(s).  Proof of Insurance can also be provided if addressing a No Insurance ticket.

You must include your email address on your entry of appearance or request for recommendation.

The prosecuting attorney cannot continue your case for you.  If a continuance is requested a Motion to Continue must be filed with the Court.  If neither the defendant nor the attorney appears for a scheduled court date there is the possibility that a warrant will be issued for the arrest of the defendant. 

Many dispositions do not require a personal appearance in Court.  However, some case may require the physical appearance of both the defendant and the attorney.  All cases resolved by a sentence that includes probation require a personal appearance.  Any cases involving the following usually require a personal appearance: Driving While Intoxicated, high speed offenses, Assault, Resisting Arrest and other similar offenses.

If the recommendation includes an amendment of the charge with a fine and court costs, payment information will be stated at the bottom of the recommendation.  The terms of the recommendation include payment in full at the time of disposition.  DO NOT FILE THE RECOMMENDATION WITHOUT CONCURRENTLY SUBMITTING PAYMENT IN FULL.  If special circumstances exist to allow a payment plan that will be considered by the prosecuting attorney upon request in person in court.

All announcement dockets begin at 9:00 a.m.  The Municipal Prosecuting attorney is usually present 30 minutes prior to the docket (or when the bailiff opens the courtroom) for discussions with attorneys.  Trials are at 1:00 p.m.

For cases involving a traffic accident, please provide proof to the prosecutor that all claims have been paid or that all claims will be paid by insurance, to obtain a recommendation.

Discovery – In accordance with Rule 37.54, the prosecuting attorney will provide a copy of the police report, if one exists, upon the filing of a request for discovery. If you are requesting photographs or videos, please mail a letter requesting copies of the video/photographs to:

Include a blank DVD and a self-addressed stamped envelope to return the DVD/flash drive.

If you have questions or requests regarding a recommendation or discovery request those can be sent to HerculaneumPA@wegmannlaw.com.  Due to the volume of cases and time constraints it is unlikely that telephone conferences will occur between counsel, absent unusual circumstances. Generally, recommendations can be discussed during the court docket.
